Lake Oswego Tree Removal Permit Rules — What You Need to Know

Lake Oswego has one of the most detailed private tree codes in the Portland metro. <parameter name=”file_text”>Any tree 6 inches DBH (diameter at breast height, measured 4.5 feet from the ground) or greater requires a permit before removal. This applies to virtually every mature tree on a residential property in the city.

Here’s how to measure DBH: wrap a tape measure around the trunk at 4.5 feet above the ground and divide the circumference by 3.14. If that number is 6 or greater, a permit is required.

The Six Permit Types

Type I — For trees between 5 and 10 inches DBH on single-family residential lots. Limited to two trees per calendar year. Issued over the counter, no fee, straightforward process.

Type II — For trees that don’t qualify for a Type I. Requires a site plan, a Type II questionnaire, a mitigation plan, and a 14-day public comment period. Fee: $50. Takes approximately one month to complete. One-to-one mitigation (replacement tree planting) is required for all Type II removals.

Dead Tree Permit — For trees that are confirmed dead. Requires documentation including a photo and a site plan. A fee applies.

Hazard Tree Permit — For trees that are cracked, split, leaning, or damaged to the degree that failure is likely. Requires a Hazard Evaluation Form completed by an ISA Certified Arborist. This is where our arborist reports become essential.

Emergency Permit — For immediate hazards. Must be documented promptly after emergency work is completed.

Invasive Tree Removal Permit — Free permit for removing invasive species like English holly, black locust, and similar trees.

Important Additional Rules

  • Mitigation is required for all Type II removals. If there’s insufficient space on your property to plant a replacement tree, mitigation may be placed elsewhere in Lake Oswego or a fee paid to the city.
  • Topping is regulated — removing 50% or more of a tree’s crown without a permit is treated as an unpermitted removal and can result in enforcement action.
  • Significant trees (over 15 inches DBH, healthy, and non-invasive) trigger additional review under Type II permits.
